Misdemeanor DUI (first offense):
Blood alcohol concentration (BAC) level registered at .08% - below .15%

  • 10 days in jail (consecutively served).  Suspension of 9 days may be possible when you agree to get an alcohol or drug evaluation and submit to the recommended treatment.
  • Fines:  $250, plus surcharge, and an addition $500.00 assessment.
  • Suspension of driver’s license for 90 days.
  • Probation:  Up to 5 years probation.

Misdemeanor DUI (second offense within 5 years):
 BAC registered at .08% - below .15%

  • 90 Days in jail (consecutively served).  60 of the 90 days could possibly be suspended if you agree to alcohol/drug evaluation and treatment program.
  • Fine:  $500 fine, a surcharge and a $250 assessment, plus an additional $1250 assessment.  Total = over $2,000 in fines and fees.
  • Driver’s license revoked for one year.
  • Probation for up to 5 years.
  • Ignition Interlock Device required to be installed in any vehicle you drive.

First Extreme DUI conviction (BAC registered at above .15%):

  • 30 days in jail (served consecutively).  20 of the 30 days could be suspended if you agree to drug/alcohol evaluation and treatment programs.
  • Fines of $250, plus surcharge, as well as $250 assessment plus $1,000.  Total fines and fees = more than $1,500.
  • 90 day driver’s license suspension.
  • Probation for up to 5 years.
  • Ignition Interlock Device required to be installed in any vehicle you drive.

Second Extreme DUI conviction (within five years):

  • 120 days in jail, (60 days must be consecutively served.  60 days may be suspended if you agree to a  drug/alcohol evaluation and treatment program.
  • Fines of $500, plus surcharge, plus $250 assessment as well as $1250 further assessment.  Total fines and fees:  over $2,250.
  • Driver’s license revoked for 1 year.
  • Probation for up to 5 years.
  • Ignition Interlock Device required to be installed in any vehicle you drive.
